Super complaints must be heard, regardless of merit

Superannuation trustees have been told by the Superannuation Complaints Tribunal (SCT) that fund member complaints must be allowed due process, regardless of their merits.

The chairperson of the SCT, Jocelyn Furlan has used her latest quarterly report to acknowledge comments from some trustees that the Tribunal put them to significant effort even when it is likely that a complaint will ultimately be withdrawn.

She warned however that trustees needed to accept that those making complaints not only had the right to be heard but an opportunity to understand why their complaint was likely to be withdrawn.

“The Tribunal must provide the complainant with relevant information as to why withdrawal is being considered, as well as the Tribunal’s reasons,” Furlan said.

“The complainant must be given the opportunity to be heard; that is, to provide any submission to the Tribunal which he or she might wish to make as to why the complaint should not be withdrawn,” she said.
